These PureKVA Terms of Use (“PureKVA Terms”) govern End User’s access to and use of the PureKVA software offering (“PureKVA”). These Terms supplement the Everpure End User Agreement (the “Agreement” or “EUA”). Capitalized terms used but not specifically defined in these PureKVA Terms shall have the meanings ascribed to them in the Agreement.
1. EVALUATION LICENSE GRANT AND DURATION.
1.1 License Grant. Subject to End User’s compliance with the Agreement and these Terms, Everpure grants to End User a nontransferable, nonexclusive, revocable, terminable right and license to download, install, and use the Software, in executable object code format only, solely for End User’s internal evaluation and business operations.
1.2 Introductory Term. The Software is provided on a promotional, complimentary basis for a strict duration of one (1) year commencing on the date PureKVA is made available to End User (the “Introductory Term”).
1.3 Operational Expiration and Non-Auto-Renewal. This subscription license will not automatically renew, nor does it feature automated technical termination or software-enforced code-blocks within the current minimum viable product (MVP) release. Notwithstanding the absence of a technical lockout upon expiration, End User’s legal right to access and use the Software automatically terminates immediately upon the conclusion of the Complimentary Term. Any continued use of PureKVA post-expiration without an executed, paid renewal via an authorized Everpure reseller shall constitute a material breach of the Agreement. All renewals and extensions must be negotiated and managed operationally through the applicable Everpure sales team.
2. INFRASTRUCTURE-BASED DEPLOYMENT AND USAGE RESTRICTIONS.
2.1 Flashblade Backend Deployment. End User is permitted unlimited capacity usage and data allocation if End User deploys and runs PureKVA natively utilizing an Everpure FlashBlade backend architecture.
2.2 Non-Flashblade Backend Deployment (Technical Cap). PureKVA’s load and store operations are technically capped and restricted to a maximum cache limit of 256 unique chunks if End User deploys PureKVA on any non-FlashBlade backend architecture.
2.3 Intended Product Behavior. End User acknowledges and agrees that the 256-unique-chunk restriction is an inherent, hard-coded technical cap governing non-FlashBlade environments. PureKVA will automatically enforce its technical limitation and restrict further data caching if End User attempts to exceed this threshold. End User explicitly agrees: (a) that such technical restriction constitutes expected and intended product behavior; (b) does not constitute a product defect, system failure, service outage, or degradation of service; and (c) these limitations shall not trigger any liability, indemnification, or breach of warranty obligations on the part of Everpure.
3. PRODUCT RESTRICTIONS AND SECURITY COMPLIANCE.
3.1 Universal Restrictions. End User shall not directly or indirectly reproduce, modify, distribute, rent, lease, sublicense, or use PureKVA to develop a similar product or service. Reverse engineering, decompilation, or disassembly of PureKVA components or data structures is strictly prohibited except to the extent expressly permitted by applicable law.
3.2 Prohibition on Probing Enforcements. In accordance with Section 1.4 of the Agreement, End User is strictly prohibited from executing any static or dynamic code analysis, vulnerability scanning, or penetration testing tools against PureKVA to map, bypass, or test the operational enforcement of the 256-chunk cache limit or the 1-year license expiration. Any such unauthorized activity shall be deemed a material breach of the Agreement.
4. ITERATIVE DEVELOPMENT AND COMPLIANCE AUDITING.
4.1 Future Commercialization. End User acknowledges that this complimentary iteration of PureKVA is provided as an early-stage offering. Everpure reserves the right to introduce subsequent feature-rich, high-performance commercial versions of PureKVA that may implement automated license verification, telemetry reporting via Pure1 Reports, and automated technical expiration locks. Everpure is under no obligation to maintain a complimentary subscription tier past the designated Introductory Term.
4.2 Verification and Compliance. Everpure retains all right, title, and interest in and to PureKVA and any related documentation. In alignment with Everpure's retained rights, Everpure reserves the right to operationally audit and review End User’s infrastructure deployment logs to verify strict adherence to the backend deployment restrictions set forth in Section 2 of these Terms.
5. Warranty Disclaimer. PUREKVA IS PROVIDED "AS-IS", WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND. EVERPURE DOES NOT WARRANT THAT PUREKVA WILL FUNCTION ERROR-FREE OR UNINTERRUPTED, OR THAT PUREKVA WILL MEET END USER’S REQUIREMENTS. EVERPURE EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY OR RESULTS, AND FITNESS FOR A PARTICULAR PURPOSE. END USER ASSUMES ALL RISK ASSOCIATED WITH CACHE LIMITATIONS ENFORCED ON NON-FLASHBLADE BACKENDS.
6. General Terms. These PureKVA Terms supplement the Agreement (or other written agreement covering the same subject matter executed by Everpure) for the Product or Services purchased by End User. Capitalized terms not specifically defined herein have the same meaning as in the Agreement. Everpure reserves the right to update these Terms from time to time, as noted by the “Last Updated” date below.
